Health & Fitness Declaration Policy

1. Purpose

This Health & Fitness Declaration Policy is intended to help ensure the safety, comfort, and well-being of all guests participating in Zyvago programmes, tours, cultural experiences, and travel activities.

While Zyvago's experiences are primarily designed around urban and cultural exploration within and around Kolkata during the Durga Puja period, guests acknowledge that certain activities may involve:

• Extended walking

• Standing for prolonged durations

• Exposure to crowded public areas

• Variable weather conditions

• Traffic congestion

• Uneven roads or pathways

• Public gatherings and festival crowds

Guests are expected to assess their own physical condition, comfort level, and suitability for participation prior to booking and travel.

2. Guest Responsibility & Fitness to Travel

By participating in any Zyvago programme, guests confirm that, to the best of their knowledge:

• They are medically and physically fit to travel;

• They are capable of participating in the planned itinerary and related activities;

• They do not suffer from any condition that may pose a direct risk to themselves or others during travel;

• They understand the nature of festival-related travel conditions, including crowds, noise, traffic, and walking requirements.

Guests are encouraged to consult a qualified medical professional prior to travel if they have any concerns relating to:

• Mobility limitations

• Heart or respiratory conditions

• Recent surgeries or injuries

• Chronic medical conditions

• Pregnancy

• Anxiety or crowd sensitivity

• Allergies or dietary restrictions

• Any condition requiring ongoing medical attention

3. Disclosure of Relevant Medical Conditions

Guests are strongly encouraged to disclose any relevant medical condition, mobility limitation, accessibility requirement, allergy, or special assistance requirement prior to travel wherever reasonably possible.

Such disclosures help Zyvago make commercially reasonable efforts to coordinate logistics and improve guest comfort where feasible. However, Zyvago does not guarantee the availability of specialized medical facilities, accessibility infrastructure, dietary accommodations, or emergency support at all locations.

Any medical or personal information shared shall be handled reasonably and only for operational or safety-related purposes where necessary.

4. Medical Expenses & Insurance

Zyvago does not provide medical insurance, health insurance, accident insurance, evacuation coverage, or travel insurance as part of its services unless explicitly stated otherwise in writing.

Guests remain solely responsible for:

• Obtaining suitable travel and medical insurance coverage;

• Carrying necessary medications and prescriptions;

• Managing their own medical conditions;

• Any hospitalization, emergency treatment, medical transport, or healthcare expenses incurred during travel.

Zyvago strongly recommends that all guests obtain comprehensive international travel insurance prior to travel.

5. Medical Emergencies During Travel

In the event of illness, injury, medical discomfort, fatigue, panic, or any health-related concern during the program, guests are expected to promptly inform the Zyvago coordinator or relevant representative wherever reasonably possible.

While Zyvago may assist in arranging reasonable local support or medical attention where feasible, Zyvago shall not be held liable for:

• Availability or quality of medical treatment;

• Delays in emergency response;

• Medical outcomes;

• Hospitalization expenses;

• Transport disruptions caused by medical situations;

• Decisions made by hospitals, doctors, authorities, or emergency responders.

Any costs arising from medical treatment, emergency care, evacuation, transport modifications, or hospitalization shall remain the sole responsibility of the guest.

6. Emergency Medical Consent & Incapacitation Authorization

Guests acknowledge and understand that participation in travel programs, public cultural events, road transportation, crowded festival environments, and related activities may occasionally involve unforeseen medical situations, injuries, health emergencies, or circumstances requiring urgent medical attention.

In the event that a guest becomes unconscious, medically incapacitated, disoriented, physically unable to communicate, or otherwise incapable of providing informed consent for immediate medical care, the guest expressly authorizes local doctors, hospitals, emergency responders, licensed medical practitioners, ambulance providers, and relevant medical institutions to undertake such immediate and reasonably necessary emergency medical measures as may be considered appropriate in good faith for the purpose of:

• Preserving life;

• Preventing serious deterioration of health;

• Stabilizing the medical condition;

• Preventing further injury or harm; or

• Providing urgent emergency care pending further instructions or formal consent procedures.

Where reasonably possible, Zyvago and/or the relevant medical providers may attempt to contact the guest's emergency contact person, family member, authorized representative, or next of kin for additional information, coordination, or further formal consent.

However, guests acknowledge and agree that the inability to immediately establish contact with such persons shall not prevent or delay local medical practitioners, hospitals, emergency responders, or healthcare institutions from taking reasonable emergency measures considered necessary for the protection of the guest's health, safety, or life.

Guests further acknowledge that medical decisions, treatment protocols, emergency procedures, hospitalization decisions, and healthcare actions shall remain under the independent professional judgment and authority of the attending medical practitioners and healthcare institutions.

Zyvago shall not be held responsible for medical outcomes, treatment decisions, hospital protocols, emergency response timelines, availability of medical facilities, or healthcare-related actions undertaken by independent medical professionals or institutions.

Any medical expenses, hospitalization charges, ambulance costs, treatment expenses, evacuation costs, medications, or related healthcare expenditures incurred shall remain solely the responsibility of the guest and/or the guest's insurers or representatives.

7. Participation & Operational Discretion

Zyvago reserves the right to reasonably restrict, modify, or discontinue participation in any activity where a guest's visible medical condition, intoxication, unsafe behavior, or inability to safely participate may:

• Endanger the guest;

• Endanger other participants;

• Disrupt programme operations; or

• Create unreasonable safety or logistical concerns.

Such decisions, where necessary, shall be made in good faith with reasonable regard for guest safety and operational practicality.

7. Limitation of Liability

Guests acknowledge that participation in public cultural events, festival environments, city travel, and group experiences may involve ordinary travel-related risks including crowds, traffic, weather conditions, public movement, fatigue, and unforeseen disruptions.

By participating in the program, guests voluntarily assume such ordinary travel-related risks to the extent permitted under applicable law.

8. Governing Law & Jurisdiction

This Health & Fitness Declaration Policy shall be governed by and construed in accordance with the laws of India.

Any dispute arising in connection with this Policy or participation in any Zyvago programme shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.
